Visão crítica da legitimidade da ação popular constitucional: um instrumento a serviço da democracia

Resumo
O panorama jurídico encontra-se hoje permeado pelos ideais positivistas, refletindo uma posição conservadora de juristas que corroboram para a perpetuação da dogmática jurídica e infelizmente nutrem o desrespeito aos direitos fundamentais, que enunciam o anseio universal dos homens. Neste diapasão, não se permite o exercício dos direitos fundamentais como ordena os axiomas do povo, pelo contrário há uma forte contraposição a eles em virtude da norma e de sua absoluta soberania. A visão crítica vem revitalizar o verdadeiro papel do direito, isto é, reconstruir, com olhos para o futuro, a sustentabilidade dos objetivos teleológicos do direito, o bem estar social. Contudo, a visão crítica depende de meios para a sua efetivação, ou seja, de instrumentos hábeis e eficazes. Neste tocante, pauta-se pela legitimidade da ação popular que, ao legitimar qualquer do povo, contribui para a soberania popular, ou melhor, sedimenta com muita solidez o regime democrático estatuído no Brasil. Hoje o cenário jurídico se apresenta dogmático e positivista, aclamando a superioridade de uma norma, posta como fundamental, em detrimento dos reclames ontológicos e axiológicos, isto é, a inobservância dos direitos fundamentais em razão da lei vigente. Deste modo, a abordagem crítica, perfaz o cumprimento dos direitos constitucionais (art 3º CF/88) com a atuação efetiva do povo, para atingir a sua sustentável emancipação jurídica, política e social. Assim, esta pesquisa percorreu uma trilha para especificar a visão crítica que circunda a legitimidade popular, tendo como ponto de partida a origem da ação popular em Roma, passando por vários momentos históricos, tais como a idade média até hoje. Abordou-se a questão dos valores que a sociedade erigiu com o fito de constituir um Estado e Governo aptos a buscarem o bem comum. Analisou o regime democrático como meio mais propício de viabilizar a emancipação social dos cidadãos. Após essa análise de cunho política aferiu-se a ação popular e sua legitimidade sob à luz da dogmática jurídica e, por fim, construiu-se uma visão crítica, com fulcro na Teoria Crítica do Direito, do instituto da legitimidade popular tendo como referências as categoria críticas.

Critical view of the popular action constitutional legitimacy – an instrument in the service of democracy
Abstract
The legal landscape today is permeated by positivist ideas, reflecting a conservative view of lawyers who serve to support the perpetuation of legal dogmatics and unfortunately nourish the disrespect of fundamental rights, which set the universal desire of men. In this vein, do not allow the exercise of fundamental rights such as ordering the axioms of the people, on the contrary there is strong opposition to them by virtue of his absolute rule and sovereignty. The critical vision come true revitalize the goal of law, that is, rebuild, with an eye to the future sustainability of the teleological goals of law, social welfare. However, the critical view depends for its realization, is skilled and effective tools. In this regard, is based on the popular legitimacy of that action, to legitimize any of the people, contributing to popular sovereignty, or rather settles very laid solid democratic regime in Brazil. Today the scenario presents itself dogmatic and legal positivism, hailing the superiority of a standard, called as fundamental to the detriment of advertisements ontological and axiological, it means the breach of fundamental rights on grounds of law. Thus, the critical approach, represents the fulfillment of constitutional rights (Article 3 of CF/88) with the activeness of the people to achieve their emancipation sustainable legal, political and social. Thus, this research has traveled a path to specify the critical view that surrounds the popular legitimacy, taking as its starting point the origin of popular action in Rome, passing through several historic moments such as the average age today. Addressed the question of values that society has erected with the purpose of constituting a State Government and able to seek the common good. Examined the democratic way as a means of enabling a more conducive social empowerment of citizens. After this analysis has measured the political slant to their legitimacy and popular action in the light of legal dogmatics and eventually built up a critical view, with focus on the Critical Theory of Law, the Institute of popular legitimacy having as references the critical category
