Acesso à Justiça como Fator de Inclusão Social das Pessoas Financeiramente Hipossuficientes e a Contribuição dos Serviços de Assistência Judiciária Gratuita

Resumo

Este trabalho possui o escopo de apresentar as diversas faces do direito fundamental de acesso à justiça. As limitações externas e internas ao processo, na grande maioria das vezes, impedem os indivíduos de buscarem em juízo a solução dos litígios que se veem envolvidos.São limitações de ordem financeira, cultural, técnica e até mesmo de falta de conhecimento acerca da legislação pátria.Os estudiosos do assunto apresentam diversas formas de serem superadas as barreiras ao acesso à justiça, tais como: a concessão do benefício da assistência judiciária gratuita, criação da Defensoria Pública, outorga do jus postulandi diretamente à parte envolvida no litígio e o investimento na educação e cultura da população, com o fim de propiciar a esta à possibilidade de identificar com mais facilidade seus direitos. Saliente-se, ainda, a importante contribuição dos Serviços Assistência Judiciária no alargamento do direito ao acesso à justiça, que, por meio dos serviços prestados pelos estagiários, sob a supervisão de um professor orientador, prestam grande serviço social às pessoas financeiramente hipossuficientes.

Abstract

This work has the scope to present the many faces of the fundamental right of access to justice.The external and internal constraints to the process, in most cases, prevent individuals from seeking judgment in the resolution of disputes which find themselves involved. Limitations are financial, cultural, technical and even lack of knowledge about laws homeland.The scholars have presented various ways to overcome barriers to access to justice, such as the granting of free legal aid, the creation of the Public Defender, jus postulandi grants directly to the party to the dispute and investment in education and culture population, in order to provide this opportunity to more easily identify their rights.It should be noted also the important contribution of offices / centers of legal practices of Brazilian universities and colleges in extending the right to access to justice, which, through the services provided by interns under the supervision of a teacher advisor, providing great social services to persons financially inapt.
