Resumo

A elaboração desta tese teve como finalidade mostrar a Garantia Constitucional do Princípio do Contraditório e da Ampla Defesa, como um procedimento do Devido Processo Legal, visto que a própria Constituição Federal garante através do art. 5º, LV, quando diz que aos litigantes, em processo judicial ou administrativo, e aos acusados em geral são assegurados o contraditório e ampla defesa, com os meios e recursos a ele inerentes e seu reflexo da cláusula do due process of law. O contraditório é tido como o princípio norteador do próprio conceito da função jurisdicional, por isso é que este princípio tem que ser obedecido. Este trabalho se baseará nos Direitos Humanos, visto que hoje busca-se conciliar o direito moderno através dos direitos do homem, pois a dignidade da pessoa humana é vista como um princípio basilar universal.

Abstract

The elaboration of this thesis had as purpose to show the Constitutional Guarantee of the Principle of the Contradictory and Legal defense, as a procedure of Due process of law, since the proper Federal Constitution guarantees through art. 5º, LV, when it says that to the litigants, in action at law or administrative, and to the defendant and, generality is assured the contradictory and legal defense, with the ways and inherent resources it and its consequence of the clause of due process of la. The contradictory is had as the norteador principle of the proper concept of the jurisdictional function, therefore it is that this principle has that to be obeyed. This work will be based on the Human Rights, since today it searchs to conciliate the modern right through the rights of the man, therefore the dignity of the person human being is seen as a universal fundamental principle.
