Resumo

O avanço tecnológico deu dinamismo às negociações entre os diversos indivíduos do planeta. O Judiciário vem acompanhando, dentro do possível, essa evolução, para empregar celeridade na tramitação e no julgamento dos processos. A criação do processo virtual no Juizado Especial Estadual e Federal é uma forma de adaptação à modernidade e a tecnologia. Contudo, a grupos de pessoas, como os segurados da Previdência Social, que não podem esperar a tramitação normal do processo, pois o benefício lhe provém a subsistência e da sua família. A criação do instituto da antecipação da tutela possibilita que o segurado receba o benefício enquanto tramita o seu processo. O presente trabalho de dissertação tem o objetivo a analise da Seguridade Social, a divisão entre Previdência e Assistência Social e pondera sobre os princípios do segurado e da administração. Avalia o instituto da antecipação da tutela, seu conceito e pressupostos e a possibilidade de sua aplicação contra a Fazenda Pública. Finalmente, analisa a possibilidade de concessão da antecipação da tutela em cada um dos benefícios previdenciários, a defesa dos interesses dos segurados através das ações coletivas e em especial à proteção do idoso e também a possibilidade de antecipação da tutela no benefício assistencial. Conclui que, através da antecipação da tutela é possível propiciar acesso efetivo à justiça, imprimir celeridade processual, com fim de dar ao segurado, o direito material que deseja de forma célere e dinâmico.

Anticipating from the Protection at the Actions from the Benefits Government

Abstract

Technological advances gave momentum to the negotiations between the various individuals on the planet. The Judiciary is accompanied, where possible, such developments, for use in processing speed and trial procedures. The creation of the virtual procedure in State and Federal Special Court is a way of adapting to modernity and technology. However, the groups of people, as the insured's Social Security, which can not wait for the normal conduct of proceedings, as the benefit it comes to subsistence and their families. The creation of the Office of the anticipation of protection enables the insured receives the benefit as the deal process. The work of this dissertation is aimed to examine Social Security, the division between Welfare and Social Welfare and weighs on the principles of the insured and the administration. Assesses the institution of the anticipation of trust, its concept and assumptions and the possibility of its application to the Public. Finally, examine the possibility of granting protection in advance of each of the benefits, the protection of policyholders interests through collective actions and in particular the protection of the elderly and also the possibility of anticipation in the custody of welfare benefit. It concludes that, by anticipation of guardianship can provide effective access to justice, procedural print speed, with view to the insured, the right material you want in a quick and dynamic.
