A Aplicabilidade da Decisão Estrutural no Microssistema Processual Coletivo Ativo e Passivo

Resumo
Este trabalho aborda a técnica processual das decisões estruturais aplicada às ações coletivas. Busca-se traçar as origens, a definição, a estrutura, os requisitos e os pressupostos da decisão estrutural, sob o prisma do neoconstitucionalismo e do paradigma instrumentalista. Demonstra-se que a tutela jurisdicional dos direitos difusos e coletivos pressupõe a alteração das tradicionais concepções acerca da função jurisdicional, assim como um modelo especial de processo. Para tanto, analisa-se a evolução da jurisdição a partir do modelo jurídico liberal-positivista, chegando-se às premissas do neconstitucionalismo desenvolvidas no âmbito do Estado Social de Direito, assim como a finalidade atribuída à função jurisdicional nas diversas fases metodológicas do direito processual. Investiga-se, outrossim, a concepção do sistema de tutela dos direitos transindividuais no Brasil, baseada no modelo referencial da class action do sistema jurídico da common law, e exploram-se as especificidades do modelo de processo coletivo brasileiro. Examina-se a definição legal dos direitos transindividuais e as implicações de suas peculiaridades sobre a atividade jurisdicional. Busca-se expor, suscintamente, o conteúdo dos princípios que regem o exercício da jurisdição coletiva. A partir das aludidas premissas, demonstra-se, mediante método dedutivo, que o controle judicial de decisões políticas decorre do exercício da ação coletiva, diante das peculiaridades das demandas transindividuais. Diante desta constatação, analisam-se os limites da discricionariedade política e administrativa das demais instâncias do poder estatal e as hipóteses que autorizam a intervenção do Judiciário em políticas públicas. Partindo-se da teoria das reformas estruturais, demonstra-se a aptidão do processo coletivo para a concretização de valores e direitos fundamentais, mediante ponderação dos interesses envolvidos na lide, com a aplicação da técnica decisória estrutural e a adoção de um procedimento aberto ao debate e à participação da sociedade. Examinam-se, por fim, os elementos da decisão estrutural e das técnicas executivas a ela aplicáveis, com vistas à prestação da tutela jurisdicional efetiva e adequada dos direitos transindividuais.

Abstract
This paper deals with the procedural technique of structural decisions applied to collective actions. It seeks to outline the origins, definition, structure, requirements and assumptions of the structural decision, under the prism of neoconstitutionalism and the instrumentalist paradigm. It is demonstrated that the judicial protection of diffuse and collective rights presupposes the change of traditional conceptions about the jurisdictional function, as well as a special model of process. In order to do so, we analyze the evolution of the jurisdiction from the liberal-positivist legal model, reaching the premises of neconstitutionalism developed within the scope of the Social State of Law, as well as the purpose attributed to the jurisdictional function in the various methodological stages of procedural law. We also investigate the conception of the system of protection of transindividual rights in Brazil, based on the reference model of the class action of the common law legal system, and explore the specificities of the Brazilian collective process model. It examines the legal definition of transindividual rights and the implications of their peculiarities on the jurisdictional activity. It seeks to expose, sundry, the content of the principles governing the exercise of collective jurisdiction. Based on the aforementioned premises, it is demonstrated, through a deductive method, that judicial control of political decisions arises from the exercise of collective action, given the peculiarities of transindividual demands. In view of this finding, the limits of the political and administrative discretion of the other instances of state power and the hypotheses that authorize the intervention of the Judiciary in public policies are analyzed. Building on the theory of structural reforms, the suitability of the collective process for the realization of fundamental values and rights is demonstrated by weighing the interests involved in the task, applying the structural decision-making technique and adopting a procedure open to debate And the participation of society. Lastly, it examines the elements of the structural decision and the executive techniques applicable to it, with a view to providing effective and adequate judicial protection of trans-individual rights.
