Resumo

O presente estudo tem como base a análise de alguns aspectos contratuais e a atuação do judiciário frente às relações jurídicas de interesse particular e público. De início trabalha-se com o contrato, trazendo a lume seu conceito desde o direito primitivo, sua origem, evolução, relativização dos pactos sunt servanda frente aos princípios constitucionais e a adoção da teoria da imprevisão, bem como a constitucionalização do pacto sunt servanda. No capítulo seguinte estuda-se a hodierna função social do contrato e os limites à liberdade de contratar, bem como os princípios contratuais previstos tanto na Constituição Federal quanto na legislação infraconstitucional. O terceiro e último capítulo cuida do Ativismo Judicial, procurando apontar em quais situações restaria configurado o denominado ativismo e se tal instituto ofenderia a Separação dos Poderes

Controversial aspects of the contract and the judicial activism

Abstract

The present work is based on the analysis of some contractual aspects and the judicial system actuation face the judicial relation of particular and public interest. First, is worked with the contract, bringing to light its concept from the primitive right, its origin, evolution, the relativizing of the pactos sunt servanda face the constitutionals principles and the adoption of the unpredictability theory, as well the constitutionalisation of the pacto sunt servanda. In the next chapter is studied the today social function of the contract and the free limits to contract , as well the contractual principles as provided in the Federal Constitution as in the infra- constitutional legislation. The third and last chapter oversee the Judicial Activism, seeking indicate in which situation would remain configured the denominated activism and if such institute would offend the Separation of Judicial Powers.
