Resumo

O estudo tem como objetivo traçar os aspectos relevantes que orientam a definição da responsabilidade pelo dano processual. Para tanto, assume-se como ponto de partida a disciplina conferida pelo processo civil a institutos como litigância de má-fé, ato atentatório à dignidade da Justiça, sucumbência e reversão de tutelas provisórias ou definitivas, para, no passo seguinte, delinear os termos fundamentais que devem orientar o exame da responsabilidade genérica pelo dano processual atípico. Traça, para tanto, um diálogo entre o direito processual e o direito material. Esmiúça os elementos constitutivos da responsabilidade pelo dano processual, como o agente ativo, a conduta e o elemento subjetivo. Por fim, divisa as hipóteses de responsabilidade subjetiva e objetiva, perpassando por temas como dolo, culpa, boa-fé objetiva, teoria do risco e abuso de direito.

Abstract

The target of this study is to outline the relevant aspects that guide the definition of liability for procedural damage. To this end, it takes as a starting point the discipline conferred by procedural law to institutes such as litigation in bad faith, act against the dignity of Justice, succumb, and reversal of provisional or definitive decisions, in order to, in the next step, outline the fundamental terms that guide the examination of generic liability for atypical procedural damage. Therefore, it outlines a dialogue between procedural law and civil liability in material law. It breaks down the elements that constitute liability for procedural damage, such as the active agent, the conduct and the subjective element. Finally, it examines the hypotheses of subjective and objective responsibility, covering topics such as deceit, fault, objective good faith, risk theory and abuse of rights.
