As cooperativas agroindustriais em face do cdc

Resumo

O presente trabalho pretende analisar as Cooperativas Agroindustriais, desde sua gênese histórica, abarcando alguns aspectos ideológicos, conceito, legislação (Lei 5.764/71) e perscrutar a incidência do Código de Defesa do Consumidor (Lei 8.078/90) sobre as atividades desta. Procurar-se-á, após desenvolver o tema, diferenciar as atividades em que ocorreria a incidência do Código do Consumidor de outras desenvolvidas pela mesma em que não se amoldaria a legislação consumerista, pautando-se ainda pelo dever de observar as tendências jurisprudenciais sobre o tema. A Lei 5.764/71 que instituiu a Política do Cooperativismo deverá ser abordada para se antever possibilidades da melhoria do sistema Cooperativista. De outro lado, também procurar-se-á verificar o que sinalizam algumas legislações de países vizinhos, pois tais comparações podem ser valiosas para uma melhor compreensão do assunto. Com relação ao aspecto prático buscar-se-á estudar algumas decisões sobre o assunto, para então, avaliá-las sob o enfoque jurídico, de outro lado, a regra da inversão do ônus da prova deverá ser abordada com vistas a se antever tal aplicabilidade face às Cooperativas Agroindustriais encampadas pela Lei 5.764/71 em confronto com a Lei 8.078/90. Ao final, buscar-se-á examinar tais espécies de Cooperativas, assim como criticar alguns aspectos do sistema com buscas a melhor efetividade e aprimoramento do Cooperativismo para que este permaneça mais perto de seus valores originais

Abstract

This study aims to examine the Agroindustrial Cooperative, from its historic genesis covering some of the ideological concept, law (Law 5.764/71) and scrutinize the impact of the Consumer Defense Code (Law 8078/90) on the activities of this. Search will, after developing the theme to differentiate the activities that occur in the incidence of the Consumer Code of the same in other developed that do not fit the consumerist legislation, guiding is also the duty to observe trends over the jurisprudential theme. Law 5.764/71 which established the Cooperative Policy should be addressed to foresee possibilities for improving the Cooperative system. On the other hand, it also will seek to verify that signal the laws of some neighboring countries, because such comparisons may be valuable for a better understanding of the subject. Regarding the practical aspect of search will study some decisions on the matter, then, to evaluate them under the legal approach, on the other hand, the rule of the reversal of the burden of proof should be approached with a view to predict whether such applicability Agribusiness Cooperatives against the expropriated by Law 5.764/71 in confrontation with the Law 8078/90. In the end, it will seek to examine these kinds of cooperatives, as well as criticizing some aspects of the system to search the best effectiveness and improvement of the Cooperative for it to remain closer to their original values.
