A Decisão Manipulativa como Instrumento de Concretização do Ativismo Judicial

Resumo

Objetivou-se com este estudo analisar os critérios delineados pelo Supremo Tribunal Federal para utilizar a denominada decisão manipulativa. Para entender a problemática, utilizou-se o método indutivo e, também, as técnicas de pesquisa documental e bibliográfica. Ainda, observou-se, em sede de direito comparado, a adoção da decisão manipulativa e, posteriormente, realizou-se um apanhado dos julgamentos do Supremo Tribunal Federal, procurando identificar a tendência da Suprema Corte. Com a análise de vários julgados selecionados por amostragem, foi possível verificar que, o Supremo Tribunal Federal tem a tendência em uniformizar a interpretação do texto legal, com o fundamento de adequá-lo à Constituição Federal. Constatou-se, também que, é possível o Supremo Tribunal Federal alterar a interpretação atribuída em sede de decisão manipulativa. Percebeu-se, ainda, que, as decisões manipulativas são justificadas na necessidade de existência de harmonia entre os Poderes Constituídos. Mostrou-se claro, que, o Supremo Tribunal Federal se considera competente para proferir decisão manipulativa sobre qualquer assunto legislativo, inclusive, sobre emendas constitucionais.

Abstract

The objective of this study was to analyze the criteria outlined by the Supreme Court for using the so-called manipulative decision. To understand the problem, the inductive method was used, as well as documentary and bibliographic research techniques. Still, it was observed, in terms of comparative law, the adoption of the manipulative decision and, later, an overview of the judgments of the Federal Supreme Court was carried out, trying to identify the tendency of the Supreme Court. With the analysis of several judgments selected by sampling, it was possible to verify that the Federal Supreme Court tends to standardize the interpretation of the legal text, on the grounds of adapting it to the Federal Constitution. It was also found that it is possible for the Supreme Court to change the interpretation attributed to manipulative decisions. It was also noticed that manipulative decisions are justified in the need for the existence of harmony between the Constituent Powers. It was clear that the Federal Supreme Court considers itself competent to issue a manipulative decision on any legislative matter, including constitutional amendments.
