Direitos Difusos e Coletivos e sua Efetividade na Educação Escolar para Pessoa com Deficiência

Resumo

O presente trabalho discorre sobre os direitos difusos que é um ramo do direito que trata de questões que ultrapassam o âmbito estritamente individual. É um tema em evolução. Sua essência está na indivisibilidade do objeto, na indeterminabilidade cuja origem seja a união por circunstâncias fáticas. São caracterizados como direitos transindividuais, ou seja, que não pertencem a um único indivíduo. Entre seus titulares a indeterminabilidade é absoluta, mais do que indeterminados, são indetermináveis. Atendem a um grupo de pessoas ou a coletividade ligadas por circunstâncias de fato. São classificados em direitos coletivos e individuais homogêneos. Os direitos coletivos têm como titulares as pessoas integrantes de um determinado grupo, categoria ou classe. Os individuais homogêneos, são os decorrentes de origem comum, ou seja, na mesma relação jurídica. A finalidade deste estudo foi compreender a abrangência do direito coletivo e individual homogêneo e sua aplicabilidade. Optou-se por discorrer sobre o direito à educação, especialmente a educação escolar destinada para pessoas com deficiências. Destaca que por educação especial, compreende-se a modalidade de educação escolar, oferecida preferencialmente na rede regular de ensino, para educandos com deficiência. O método foi o hipotético dedutivo e a metodologia utilizada foi a pesquisa bibliográfica e a pesquisa de campo. Para conhecer como o direito à educação escolar para pessoas com deficiências acontece na realidade, foi necessário conhecer a legislação escolar, selecionar um município que ofertasse todas as modalidades de ensino correspondente à educação básica para identificar a aplicabilidade das leis e regulamentos. Conclui-se que educação especial e educação inclusiva têm conotações diferentes e ainda é pouco compreendida pelos agentes promotores da educação escolar.

Abstract

The present work discusses diffuse rights, which is a branch of law that deals with issues that go beyond the strictly individual scope. It is a relatively new topic. Its essence is in the indivisibility of the object, in the indeterminability whose origin is the union by factual circumstances. They are characterized as transindividual rights, that is, they do not belong to a single individual. Among its holders, indeterminability is absolute, more than indeterminate, they are indeterminable. They serve a group of people or the community linked by de facto circumstances. They are classified into collective and individual rights. Collective rights are held by persons belonging to a certain group, category or class. Individuals are those arising from common origin, that is, in the same legal relationship. The purpose of this study was to understand the scope of collective and individual law and its applicability. It was decided to discuss the right to education, especially school education for people with disabilities. It emphasizes that special education is understood as the modality of school education, preferably offered in the regular education network, for students with special needs. The method was hypothetical deductive and the methodology used was bibliographic research and field research. In order to know how the right to school education for people with disabilities happens in reality, it was necessary to know the school legislation, select a municipality that offered all the teaching modalities corresponding to basic education to identify the applicability of the laws and regulations. It is concluded that special education and inclusive education has different connotations and is still poorly understood by the promoters of school education.
