Do laudo médico-pericial e sua força probante na análise de benefícios por incapacidade

A presente dissertação analisa a relevância e a força probante do laudo médico-pericial nas ações judiciais que buscam a concessão de benefícios por incapacidade, sob a ótica da proteção dos direitos fundamentais à previdência social e à produção probatória. O ponto de partida da pesquisa é a constatação de que, embora a Constituição Federal de 1988 eleve os direitos sociais à categoria de fundamentais, a efetivação desses direitos encontra obstáculos significativos na prática processual, especialmente para os segurados em situação de vulnerabilidade econômica dependentes do Sistema Único de Saúde (SUS). O objetivo geral do estudo é investigar a necessidade de evolução do modelo pericial atual, confrontando, por meio da análise de casos práticos e decisões judiciais, a soberania fática que a perícia médica parece exercer nas decisões judiciais com o sistema da livre persuasão racional do juiz e a ausência de hierarquia entre as provas. Metodologicamente, utilizou-se o método hipotético-dedutivo, com pesquisa bibliográfica e análise de alguns casos práticos perante os Tribunais Regionais Federais. No primeiro capítulo, discute-se a seguridade social como instrumento de dignidade humana e a influência da vulnerabilidade social no ônus da prova, destacando-se a insuficiência do modelo biomédico tradicional frente à necessidade de uma análise biopsicossocial que considere fatores ambientais e profissionais. O segundo capítulo debruça-se sobre o sistema probatório brasileiro, reafirmando o direito fundamental à prova e a natureza da perícia médica como ato processual sujeito ao contraditório. No terceiro capítulo, são expostos os obstáculos práticos da prova pericial, como a falta de especialidade técnica dos peritos e as contradições verificadas em estudos de caso. Por fim, o quarto capítulo propõe melhorias estruturais e estratégias processuais para mitigar a disparidade de armas, tais como a implementação do assistente técnico “dativo” para hipossuficientes, a gravação em áudio e vídeo das perícias para garantir a publicidade e o uso de precedentes, como o Tema 343 da Turma Nacional de Uniformização dos Juizados Especiais Federais (TNU), para valorizar o conjunto probatório além do laudo pericial. A perícia não deve ser um fim em si mesmo, mas um meio de se alcançar a verdade processual que respeite a condição existencial do segurado e a eficácia dos direitos sociais, devendo ser confrontada às demais provas do processo.

This dissertation analyzes the relevance and evidentiary weight of the medical-expert report in lawsuits seeking disability benefits, from the perspective of protecting the fundamental rights to social security and evidence. The research starts from the observation that, although the 1988 Federal Constitution elevates social rights to the status of fundamental ones, the effective realization of these rights faces significant obstacles in procedural practice, especially for economically vulnerable insured persons dependent on the Unified Health System (SUS). The general objective of the study is to investigate the need for an evolution of the current expert model, confronting, through the analysis of some practical cases and judicial decisions, the factual sovereignty that the medical expertise exercises in judicial decisions with the judge's principle of rational persuasion and the absence of hierarchy between types of evidence. Methodologically, the hypothetical-deductive method was used, with bibliographic research and the study of practical cases before the Federal Regional Courts. In the first chapter, social security is discussed as an instrument of human dignity and the influence of social vulnerability on the burden of proof, highlighting the insufficiency of the traditional biomedical model in the face of the need for a biopsychosocial analysis that considers environmental and professional factors. The second chapter focuses on the Brazilian evidentiary system, reaffirming the fundamental right to evidence and the nature of medical expertise as a procedural act subject to the adversary principle. In the third chapter, the practical obstacles of expert evidence are exposed, such as the lack of technical expertise of the court-appointed experts and the contradictions found in case studies. Finally, the fourth chapter proposes structural improvements and procedural strategies to mitigate the inequality of arms, such as the implementation of "court-appointed" technical assistants for the poor, the audio and video recording of expertise sessions to ensure publicity, and the use of precedents, such as TNU Theme 343, to value the evidence set beyond the medical report. It is concluded that the medical expertise should not be an end, but a means of achieving a procedural truth that respects the existential condition of the insured and the effectiveness of social rights.
