Documento eletrônico: a (in) eficácia da prova da infidelidade virtual nas ações de separação judicial e reparação de danos

Resumo
O adultério difere-se da infidelidade, pois aquele necessita, além do contato físico com terceiro, ser o adúltero pessoa casada, requisitos estes dispensáveis para caracterizar a infidelidade, haja vista que essa pode acontecer entre casais de namorados, bem como em amizades, sem a obrigatoriedade da ocorrência de relação sexual. A infidelidade é o desrespeito a um dos efeitos do matrimônio, qual seja, a fidelidade recíproca, enquanto o adultério é uma causa para dissolução da sociedade conjugal. Porém, a infidelidade virtual também é admitida como causa de separação litigiosa com culpa, pois se enquadra na conduta desonrosa. Causas como adultério e infidelidade virtual também podem ser motivos para pleitear indenização por danos morais e materiais, desde que tais condutas praticadas pelo cônjuge ofensor afetem a honra da vítima. No entanto, é preciso que o pedido de reparação, no caso de danos morais, seja imediato. Tais fatos jurídicos ocorridos na rede podem ser demonstrados através de documentos eletrônicos, em razão de técnicas criadas para garantir que as informações transmitidas na rede mundial sejam seguras e confiáveis. São exemplos de mecanismos que garantem a segurança das informações enviadas e recebidas na web, a criptografia simétrica e a assimétrica, assinatura digital. Através das técnicas mencionadas, a interceptação das mensagens, ou mesmo a alteração de qualquer dado de um determinado documento poderá ser reconhecida e é em razão dessas técnicas que se concebe o documento eletrônico como passível de ser utilizado de forma tranqüila no sistema processual e, desse modo, efetivar a busca pela verdade, objetivo do processo. O ordenamento constitucional proíbe, no processo, a produção de provas obtidas por meio ilícito. No entanto, embora não se admitida a utilização da prova ilícita no processo civil, a doutrina tem, por vezes, se mostrado receptiva à aplicação do princípio da proporcionalidade. Tal princípio possibilita a utilização do referido meio de prova, sem afrontar o direito à intimidade, quando, no caso concreto, outros direitos estiverem envolvidos e forem considerados mais relevantes para a sociedade. Assim, uma vez firmado o entendimento acerca da admissibilidade da prova ilícita no processo civil, o cônjuge lesado poderá demonstrar em juízo, através dos documentos eletrônicos, a violação do dever de fidelidade recíproca praticado pelo cônjuge ofensor.

Electronic document: the (in) efficacy of virtual infidelity proof in the judicial separation cases and damage repair
Abstract
The adultery differs from infidelity because the person needs besides being married, have physical contact with a third person which are dispensable requisites to characterize the infidelity because it can happen between single couples as well as among friends without occuring necessarily a sexual intercourse. The infidelity is the disrespect to one of the effects of marriage that is, mutual fidelity, while the adultery is a cause for dissolution of the conjugal society. However, the virtual infidelity is also admitted as cause for litigious separation with guilt because it fits in dishonorable conduct. Cases like adultery and virtual infidelity can also be reasons to plead indemnizations by moral and material damage, since such behaviours practiced by the offensive spouse affect the honor of the victim. Neverthless, it is necessary that the request for separation in the case of moral harm, be immediate. Such juridical facts which happened on the net can be demonstrated through the electronic documents due to technics created to guarantee that the information transmitted on the world net be safe and trusty. Examples of mechanisms that guarantee the information safety sent and received on the web are symmetric and asymmetric cryptography, digital signature. Through such technics mentioned the interceptation of messages or even the alteration of any date of a determined document can be recognized as well as because of such technics is that it is conceived the electronic document which is able to be used in a tranquil way in the law system and in this way accomplish the search for the truth that is the target of the process. The constitutional ordinance prohibits in the process to get proofs by illicit way. Although not admitted the use of illicit proof in the civil process, the doctrine has been giving room to apply the proportionality principle which makes it possible the use of such way of proof not affronting the right to intimacy when in the real case other rights are involved and considered more relevant to the society. So, once firmed the understanding around the admissibility of the illicit proof in the civil process, the offended spouse will be able to show to law through electronic documents the violation of mutual fidelity duty practiced by the offender spouse.
