Resumo

O presente trabalho faz uma reflexão sobre a constante evolução da sociedade em relação ao direito que não pode permanecer desatualizado e em desacordo com as normas implícitas e explícitas na Constituição da República Federativa do Brasil. Apresentam-se soluções para se alcançar a efetividade na entrega da tutela jurisdicional a uma sociedade que clama por justiça no caso concreto, principalmente no que diz respeito aos direitos fundamentais. Para que o Poder Judiciário possa entregar ao vencedor da demanda e à sociedade uma tutela jurisdicional efetiva, deve valorizar e prestigiar as decisões dos juízes de primeiro grau, pautadas na justicialidade, ou seja, a partir de julgamentos com base na aplicação direta e imediata das normas constitucionais em detrimento das normas infra-constitucionais. A valorização das decisões judiciais de primeiro grau em momento algum tem como objetivo suprimir o duplo grau de jurisdição, mas, sim, levar às instancias superiores aquelas decisões mal fundamentadas ou desprovidas de qualquer fundamentação, e ainda aquelas fundamentadas em desacordo com a constante evolução da sociedade. Nesta dissertação demonstra-se a exigência dos cidadãos quanto ao respeito aos direitos fundamentais e o poder-dever do Judiciário em cumprir a sua função, entregando a tutela jurisdicional de acordo com a justiça no caso concreto, tendo sempre como base o momento do fato gerador aliado ao momento do julgamento.

Abstract

The present paper do a reflection about the constant evolution of the society concerning the Law which can not remain outdated and in disagreement with the implicit and explicit norms in the Federative Republic of Brazil Constitution. It presents solutions to reach the effectiveness in the delivery of the jurisdictional injunction to a society that claims for justice in the real case, mainly concerning the fundamental rights. The Judiciary Power must value and support the decisions of the first degree judges, expressed from judgments on the basis of the direct and immediate application of the constitutional rules in detriment of infra constitutional norms, so that the Judiciary Power can deliver to the winner of the demand and the society an effective jurisdictional injunction. The valuation of the first degree sentences, at any moment, has as objective to suppress the double degree of jurisdiction, but to take the higher instances of appeal those decisions which were badly based or unprovided of any recital, and also those based on disagreement with the constant evolution of the society. In this dissertation it is shown de citizens demand concerning the respect to the fundamental rights and the Judiciary duty to accomplish its function, delivering the jurisdictional injunction justice according to the justice in the real case, having always as base, the moment of the originator fact, allied to the moment of the judgment.
