Execução forçada e os títulos de crédito no âmbito do agronegócio brasileiro: cpr física e financeira

Resumo

A importância do agronegócio, da Cédula de Produto Rural, popularmente chamada de “CPR”, como título de crédito hábil para o fomento notadamente da atividade agrícola e ainda as formas de execução desta cártula motivaram o presente estudo, o qual faz uma abordagem sobre o agronegócio e seus aspectos históricos, a execução forçada e o seu surgimento, o título executivo e sua natureza jurídica, os princípios atinentes à execução civil e os títulos de crédito, as diferenças existentes entre execução forçada e o processo de execução, questões específicas acerca da CPR e suas modalidades física e financeira e suas formas de execução, e ainda, ao final, uma breve digressão sobre a impenhorabilidade da pequena propriedade rural, com ênfase no debate doutrinário e jurisprudencial, demonstrando o caminho a ser seguido desde o financiamento rural até o efetivo recebimento pelo credor do crédito inadimplido, através da execução forçada.

Enforcement and securities in the brazilian agribusiness: physical and financial cpr.

Abstract

The importance of agribusiness, the Ballot of Agricultural Product, known as “CPR”, as heading of skillful credit for the promotion of the agricultural activity and still the forms of execution of this bond have motivated the present study, which approaches the historical agribusiness and its aspects, the forced execution and its sprouting, the executive heading and its legal nature, the pertaining principles to the civil execution and the existing headings of credit, differences between forced execution and the execution proceeding, specific questions concerning the CPR and its physical and financial modalities as well as its forms of execution. Additionally, a brief approach to the restraint of mortgage of the small country property is presented, with emphasis on the doctrinal and jurisprudential debate, demonstrating the way to be followed from the agricultural financing to the effective act of receiving, by the creditor, the defaulted credit, through the forced execution.
