Resumo

Esta tese irá mostrar que a infiltração policial, consiste numa técnica de investigação para obtenção de provas e atualmente esta infiltração esta prevista na legislação pátria por meio da Lei 10.217/01, que foi inserida na Lei do Crime Organizado, a Lei 9034/95, no inciso V do seu art. 2º, onde diz que a infiltração, por agentes de polícia ou de inteligência, em tarefas de investigação, constituída pelos órgãos especializados pertinentes, mediante circunstanciada autorização judicial. Já é fato que em países onde a infiltração policial é utilizada esta é considerada um meio de investigação muito importante e eficaz no combate ao crime, principalmente em relação ao crime organizado que envolve o tráfico internacional de drogas e consequentemente a lavagem de dinheiro. A possibilidade de infiltração dos policiais foi acolhida pelo Tribunal Europeu de Direitos Humanos, desde que cumpridos determinados requisitos na sua aplicação. Portanto este trabalho tem a intenção de mostrar que é real a possibilidade desta infiltração policial ser realizada no Brasil, desde que mediante autorização policial e com todo o acompanhamento da Justiça para esta observando a atuação do policial.

Infiltração policial como meio de prova no estado democrático de direito

Abstract

This thesis will go to show that police infiltration, currently consists of one technique of inquiry for attainment of tests and this infiltration this foreseeing in the native legislation by means of Law 10,217/01, that she was inserted in the Law of the Organized Crime, Law 9034/95, in interpolated proposition V of its art. 2º, where it says that infiltration, for intelligence or policy agents, in tasks of inquiry, consisting of the specialized agencies pertinent, by means of detailed judicial authorization. Already it is fact that in countries where police infiltration is used this is considered a way of important and very efficient inquiry in the combat to the crime, mainly in relation to the organized crime that involves the international traffic of drugs consequent and the money laudering. The possibility of infiltration of the policemen was received by the European Court of Human Rights, since that fulfilled determined requisite in its application. Therefore this work has the intention to show that the possibility of this police infiltration is real to be carried through in Brazil, since that by means of police authorization and with all the accompaniment of Justice for this observing the performance of the policeman.
