Resumo

O presente trabalho visa a analisar o uso da Inteligência Artificial na atividade jurisdicional. Por meio de revisão bibliográfica, busca-se inicialmente estudar o conceito e a evolução da Inteligência Artificial, bem como a forma como essa tecnologia pode relacionar-se com a Hermenêutica Jurídica. Na sequência, investigam-se os atuais e possíveis usos da Inteligência Artificial nas profissões jurídicas e, em especial, o uso pelo Poder Judiciário para o exercício de sua atividade típica. Destaca-se a aplicabilidade da Inteligência Artificial nos casos repetitivos e precedentes, nos meios consensuais de solução de conflitos, nos juizados especiais e nos processos de execução. Em complemento, analisam-se os potenciais benefícios e riscos associados ao uso da Inteligência Artificial na atividade jurisdicional. Por fim, são feitas reflexões sobre o uso dessa tecnologia frente aos princípios constitucionais de maior relevância para o processo judicial e para o exercício da atividade jurisdicional. Conclui-se que o uso da Inteligência Artificial pelo Poder Judiciário apresenta forte tendência de crescimento e transformará o modo como a atividade jurisdicional é exercida. Entretanto, é necessário que o desenvolvimento e o uso de sistemas de Inteligência Artificial para aplicação na atividade jurisdicional respeitem a essência dos princípios constitucionais, assegurando que a automação do processo judicial não prejudique o direito a um processo justo, com respeito à dignidade humana e à independência do Poder Judiciário.

Abstract

We aim to analyze the use of Artificial Intelligence in judicial activities. Through a bibliographic review, we initially seek to study the Artificial Intelligence’s notion and its evolution, as well as how this technology can relate to Legal Hermeneutics. Then, we investigate the current and potential uses of Artificial Intelligence in the legal professions and, in particular, the use by the Judiciary to perform its typical function. We highlight the applicability of Artificial Intelligence in precedents and multiple claims, in alternative dispute resolutions, in small claims and in execution proceedings. In addition, we discuss the possible benefits and risks associated with the use of Artificial Intelligence in judicial functions. Finally, we analyze the adequacy of the use of Artificial Intelligence with the constitutional principles in the judicial procedure and judicial functions. We concluded that the use of Artificial Intelligence by the Judiciary has had a strong growth trend and it will transform the way in which the judicial function performs. However, it is necessary that the development and use of Artificial Intelligence systems for application in the courts respect the essence of constitutional principles, ensuring that the automated judicial procedure does not undermine the right to due process, respecting to human dignity and to the Judiciary independence.
