Resumo

O presente trabalho teve como objetivo explanar sobre o direito à intimidade que está previsto na Constituição Federal, bem como esmiuçar a Lei 9.296/96, para fins de entendimento. Discorreu-se sobre as deficiências da Lei, bem como sobre os novéis projetos de lei que pretendem melhorá-la. Da mesma maneira que as interceptações telefônicas podem auxiliar a Polícia a identificarem criminosos e elucidar delitos graves, também se deve ter a visão de que é necessário um maior controle estatal sobre a disseminação indiscriminada das interceptações telefônicas em nosso País, pois estas violam, frontalmente, o direito à intimidade previsto na Constituição Federal. É que tal questão é muito sensível e pode ser grave à medida de que os próprios agentes públicos estatais poderiam estar ferindo princípios básicos da Magna Carta e colocando em risco a própria democracia. Neste sentido, é que se deve evitar um Estado Policialesco, em que tudo e todos estão sendo ‘grampeados’, mas se deve, então, reservar a interceptação telefônica para os crimes realmente graves e que possam prejudicar a sociedade como um todo.

Interceptações Telefônicas à Luz da Constituição Federal de 1988

Abstract

This present study aimed to explain on the right to privacy which is expected in the Federal Constitution, and teased the Law 9.296/96, for understanding. Current on the shortcomings of the Act, as well as the “novéis” a project that want to improve it. In the same way that hijacks the phone can help the police to identify criminals and clarify serious crime, must also have the vision of the need for more state control over the dissemination of indiscriminate hijacks phone in our country because they violate, facing the right to privacy provided in the Constitution. Because this issue is very sensitive and can be serious to the extent that state officials themselves could be hurting basic principles of the Magna Carta and jeopardizing democracy itself. In this sense we should avoid a state “Policialesco”, where everything and everyone are being 'Stapled', but it must then intercept the telephone book for really serious crimes and that harms the society as a whole.
