O Estado como Destinatário das Astreintes

Resumo

Analisa-se a multa prevista no artigo 461, § 4º, do Código Processo Civil a fim de preencher a lacuna legal existente acerca do destinatário de seus valores. Busca-se solucionar a problemática a partir da investigação de sua origem, natureza jurídica, características, base legal e entendimento jurisprudencial, objetivando a eficaz entrega da prestação jurisdicional. Critica-se a reversão dos valores ao demandante, posicionamento do Superior Tribunal de Justiça, defendendo que o destinatário do montante deve ser o Estado, tendo em vista que o instituto é um meio utilizado para compelir o demandado a cumprir com a obrigação de fazer, não fazer e entrega de coisa, sendo que o seu inadimplemento deve ser entendido como uma ofensa ao Poder Judiciário. Acrescenta-se, ainda, na hipótese de o Estado ser o descumpridor da decisão judicial, que os valores advindos da multa devam ser destinados a fundos públicos.

Abstract

Analyzes the assessment provided for in Article 461, § 4th of the Civil Procedure Code, in order to fill the existing legal gap regarding the recipient of its values. The aim is to solve the problems arising from the investigation of its origin, legal nature, characteristics, legal basis and jurisprudential understanding, aiming the effective delivery of jurisdictional provide. The criticism is about the reversal of values to the applicant, Superior Court of Justice positioning, arguing that the recipient of the amount should be the State, given that the institute is a means used to compel the defendant to comply with the obligation to do, not to do and hand over of thing, wherein your default is understood as an insult to the Judiciary. Also adds to the hypothesis of State be the one that not obey the judictial decision, the value airsing from the assessment should be destined for the public fund.
