Resumo

O presente trabalho tem por finalidade analisar e discutir, a partir de estudos bibliográficos o processo civil moderno frente às regras ditadas com amparo nos Direitos Humanos. A preocupação com a efetivação das garantias e observâncias dos Direitos Humanos no plano do Direito interno é objeto de estudo no presente trabalho científico cujo tema central reside na justaposição da conquista dos Direitos Humanos com repercussão de conquistas no processo civil interno destacados em princípios fundamentais expostos na Constituição Federal de 1988. O processo no Estado de Direito se traduz em instrumento colocado à disposição do cidadão para resolução de conflitos de interesses, conflitos sociais levados à justiça, em que regras voltadas à proeminência dos Direitos Humanos merecem destaque e observância do início ao fim. As conquistas históricas no campo dos Direitos Humanos repercutem dentro do processo através de princípios constitucionais. A materialização dos Direitos Humanos, quando não observados diretamente pelo Estado Democrático, devem ser alcançados através do processo jurisdicional. O processo assume um papel importante no contexto do Estado moderno com a tarefa de distribuir justiça e promover a pacificação social. Por isso, a efetivação de Direitos Humanos passam pelo crivo de um processo quando não oferecido pelo Estado voluntariamente. O processo funciona como instrumento de garantias e seu trâmite possui a presença direta de garantias fundamentais ligadas a ideia de prevalência de Direitos Humanos. Por isso, todo o processo deve obediência ao princípio do contraditório, da ampla defesa, da proibição de produção de provas ilícitas, dentre outros princípios ligados ao devido processo legal constitucional. A ligação direta do processo civil com a Constituição Federal, além de enaltecer os Direitos Humanos, inaugura um novo processo constitucionalizado.

Procedure: Instrument materialization of Human Dignity.

Abstract

This study aims to analyze and discuss, from bibliographic studies modern civil procedure rules dictated the front with the support of Human Rights. Concern about the effectiveness of the safeguards and observance of human rights in terms of domestic law has been studied in this scientific work whose central theme is the juxtaposition of the conquest of Human Rights with effect from gains in domestic civil procedure posted on the fundamental principles set out in Constitution of 1988. The process in the rule of law is reflected in the tool made available to the citizenry to resolve conflicts, social conflicts brought to justice, where the prominence of rules aimed Human Rights deserve attention and respect from beginning to end. The historic achievements in the field of Human Rights passed through in the process of constitutional principles.The realization of human rights, when not directly observed by the Democratic State, should be achieved through judicial proceedings. The process assumes an important role in the modern state with the task of distributing justice and promote social peace. Therefore, the realization of human rights passing through the sieve of a process when not provided by the state voluntarily. The process works as an instrument to guarantee its course and has direct presence of the fundamental guarantees linked the idea of the prevalence of Human Rights. Therefore, the whole process has to obey the principle of contradiction, legal defense, the ban on illegal production of evidence, among other principles relating to constitutional due process. The direct link of civil procedure with the Federal Constitution, and commend the Human Rights initiated a new process constitutionalized.
