Processos Estruturais no Sistema Brasileiro: Características do Processo, Concretização de Direitos Fundamentais e Legitimidade Democrática do Poder Judiciário

Resumo
O trabalho analisou os processos estruturais sob o prisma da efetividade das decisões judiciais e concretização de direitos. Com este objetivo abordou-se a importância do processo e sua instrumentalidade como meio de solução de conflitos e, num contexto histórico, a constitucionalização e a evolução da tutela direitos fundamentais, ressaltando-se os direitos coletivos e a influência processual do direito norte-americano nas ações coletivas no Brasil. Demonstra a inadequação do modelo processual tradicional para resolução de litígios estruturais e da origem das medidas estruturais no direito estadunidense, afirmando a aplicação das decisões estruturais no direito brasileiro e a necessidade de construção de um modelo processual como alternativa à efetivação de direitos e solução de litígios complexos. O estudo estendeu-se sobre os processos estruturais apresentando suas características e fundamentos ressaltando a questão da participação e da representatividade no processo, as formas de solução de litígios e meios de efetivação de suas decisões. Destacou decisões estruturais relevantes no Direito comparado, na jurisprudência e na doutrina nacional, defendendo sua aplicação no sistema jurídico brasileiro. A pesquisa analisou a atividade jurisdicional nos processos estruturais, sob o aspecto da intervenção judicial nos Poderes majoritários, tratando da legitimidade política do Poder Judiciário para proferir decisões estruturais contrapondo-se às críticas na adoção de uma conduta ativista. Propôs-se analisar o processo estrutural como viabilidade de modalidade processual e como forma adequada de da prestação jurisdicional e efetivação de direitos. Para tanto, utilizou-se o método analítico-descritivo com pesquisa bibliográfico-documental a artigos científicos, livros, dissertações e teses de doutorado de caráter exploratório-descritivo. Conclui-se que a efetivação de direitos e a solução adequada de litígios estruturais conduz à uma atuação mais proativa dos juízes, amoldando à uma forma legítima e forte de ativismo judicial que necessita de um procedimento que admita a efetiva participação dos afetados e a adequada atividade jurisdicional autorizada a partir da existência de violação de direitos, mas que apresenta limites e com escopo final de concretização de direitos.

Abstract
The work analyzed the structural processes under the prism of the effectiveness of judicial decisions and realization of rights. With this objective, the importance of the process and its instrumentality as a means of conflict resolution and, in a historical context, of the constitution and evolution of fundamental rights protection was addresses, emphasizing collective rights and the procedural influence of North American law on collectives actions in Brazil. It demonstrates the inadequacy of the traditional procedural model for resolving structural disputes and the origin of structural measures in US law, affirming the application of structural decisions in Brazilian law and the need to build a procedural model as an alternative to the enforcement of rights and the solution of complex litigation. The study extended over the structural processes, presenting their characteristics and foundations, highlighting the issue of participation and representativeness in the process, the forms of dispute resolution and the means of effecting their decisions. It highlighted relevant structural decisions in comparative law, jurisprudence and national doctrine, defending their application in the Brazilian legal system. The research analyzed the jurisdictional activity in structural processes, under the aspect of judicial intervention in the majority Powers, dealing with the political legitimacy of the Judiciary Power to make structural decisions, countering the criticisms of adopting an activist conduct. It was propose to analyze the structural process as the feasibility of a procedural modality and as an adequate form of judicial provision and enforcement of rights. For that, the analytical-descriptive method was use with bibliographic-documental research to scientific articles, books, dissertations and doctoral theses of exploratory-descriptive character. It was conclude that the realization of rights and the adequate solution of structural disputes leads to a more proactive role by judges. It also was conclude that by a legitimate and strong form of judicial activism that requires a procedure that admits the effective participation of those affected and the appropriate activity jurisdiction authorized from the existence of violation of rights, but that has limits and with the ultimate scope of realization of rights.
