A prova na ação de investigação de paternidade oriunda de inseminação artificial heteróloga

Resumo

A reprodução humana heteróloga é atualmente tema de insuflados debates nas mais diversas áreas, inclusive, jurídica, sobretudo quando se busca tutelar direitos e/ou imputar obrigações àqueles diretamente atingidos pelo assunto. Mister criar teses para amparar, principalmente, as pessoas que tenham nascido através destas técnicas, considerando-se o princípio isonômico constitucional, independentemente de sua situação social ou patrimonial. Através desta busca e inovação, alterou-se o Direito de Família, no tocante à filiação, paternidade e maternidade biológicas, criando-se a relação sócio-afetiva. A lei civil brasileira indica a presunção da concepção na constância do casamento, de filhos advindos de algumas técnicas de reprodução assistida, mas não soluciona todos os questionamentos éticos e jurídicos advindos da reprodução humana heteróloga, como, v.g., os direitos do filho diante do anonimato do doador. A posição majoritária inclina-se no sentido da preservação do anonimato diante da possibilidade de perturbação que este estranho poderia trazer à família do nascido e vice-versa. Além disso, os argumentos se baseiam também na alegação de que seria necessário o estabelecimento de um registro exaustivo e rigoroso do doador, tornando esse processo dispendioso e muito difícil de ser concluído. No Brasil, diante da falta de legislação nesse sentido, era aplicada a Resolução 1358/92 do Conselho Federal de Medicina que foi revogada pela Resolução 1957/2010, a qual norteia esse tipo de reprodução humana, embora administrativamente, dispondo sobre a obrigatoriedade do sigilo do doador. Por todo exposto, esta dissertação tem como pretensão analisar os principais aspectos acerca das provas na inseminação artificial heteróloga e a situação do filho advindo deste procedimento.

Proof Heterologous Artificial Insemination

Abstract

The heterologous human reproduction is currently the subject of inflated debates in several areas, including legal, especially when seeking to protect rights and / or impute obligations to those directly affected by the subject. Mister create arguments to sustain, especially people who are born through these techniques, considering the constitutional principle isonomic, regardless of their social or financial situation. Through this search and innovation has changed the family law with regard to affiliation, biological parenthood, creating the socio-emotional relationship. The Brazilian civil law states the presumption of conception during marriage, of children from certain assisted reproduction techniques, but does not resolve all ethical and legal questions arising out of heterologous human reproduction, such as, eg, the rights of the child in front of anonymity the donor. The majority position is leaning towards the preservation of anonymity due to the possibility of disturbance that could bring foreign born to the family and vice versa. Moreover, the arguments are also based on an allegation that would be necessary to establish a rigorous and exhaustive record of the donor, making the process expensive and very difficult to complete. In Brazil, there is lack of legislation to this effect was applied to resolution 1358/92 of the Federal Council of Medicine that was revoked by Resolution 1957/2010, which guides this type of human reproduction, although administratively, providing for the obligation of secrecy the donor. For all the above, this thesis has the intention to analyze the main aspects about the evidence for the artificial insemination heterologous and the situation of the child arising from this procedure.
