Resumo

O presente trabalho tem como escopo a análise de instrumentos processuais civis existentes e a importância do respeito aos precedentes judiciais, propiciando aos jurisdicionados a segurança jurídica esperada da ordem jurídica justa, na estabilidade e previsibilidade das decisões judiciais emanadas pelas Cortes Superiores, que conduzem a um ambiente de efetiva igualdade, como preceitua a Carta da República. É através da unidade na interpretação da lei que se dá coerência ao sistema jurídico. Os Tribunais Superiores têm a função de uniformizar a interpretação da lei, com respostas homogêneas às controvérsias que giram em torno da mesma questão jurídica. A essência da igualdade consiste em dar tratamento uniforme a controvérsias que se pautam em idêntica questão de direito. Portanto, um sistema não se coaduna com a ordem constitucional vigente quando, diante de situações idênticas, profere soluções antagônicas. A objetivação do sistema recursal visa propiciar, além da celeridade, uma tutela jurisdicional que atenda à unidade exigida do Direito. Assim, o sistema jurídico passa por grandes transformações, caminhando para a valorização da uniformização de jurisprudência, como meio apto à formação de precedentes, ainda que desprovidos de vinculação obrigatória, mas que conduzem o sistema, efetivamente, à coerência necessária, representada pela estabilidade e previsibilidade, que oferecem à igualdade e à segurança jurídica esperadas.

Abstract

The present work has the scope to analyze the existent instruments of Civil Law of Procedures as well as the importance of the respect to judicial precedents, in order to provide the judicial certainty expected of a fair legal order, through stable and predictable decisions from the High Courts, leading to an environment of effective equality, as dictates the Constitution. Only by the unify law interpretation provide coherence to the legal system. The High Courts have the function of uniformize the law interpretation, with homogeneous answers to the disputes concerning the same legal question. The essence of equality consists in to treat uniformly the different disputes concerning the same legal question. Therefore, a system is not consistent with the constitutional order in force when pronounce different decisions to both identical legal questions. The objective of the appellate system is to provide, more than celerity, a judicial protection that attends to the demands of unity of law. Hence, the legal system passes through a moment of great change, leading to the uniformization of the jurisprudence as an able way to the stablishment of precedents, despite its lack of binding effects, driving the system to the necessary coherence, represented by the stability and predictability that provide the equality and the required legal certainty.
