A Tutela Inibitória na Construção e Desconstrução do Direito de Imagem de Pessoa Pública

Resumo

Existe uma relação conflituosa entre o direito de imagem, inserto como uma garantia fundamental na Constituição Federal, e os veículos de informação ávidos pelo lucro. Ao agir desta forma, transforma-se a mídia em instrumento de manipulação e alienação, substituindo a verdade pelo imaginário, moldando a imagem de uma pessoa pública conforme seus interesses e conveniências, construindo-a e desconstruindo-a sem se importar que ao assim proceder macula os atributos de uma pessoa de forma temporária e muitas vezes até perpétua em nome de uma sociedade de consumo. Defende-se a veiculação da informação verdadeira com interesse efetivamente público, rechaçando os abusos praticados pela mídia. Visando conferir efetividade ao direito de imagem, salutar a adoção da tutela preventiva, a qual evita a ocorrência ou a continuidade do ilícito. O instrumento processual hábil a efetivar a tutela inibitória se dá através das obrigações de fazer e não fazer, previstas no artigo 461 do CPC.

Title

The Inhibitory Protection in Construction and Deconstruction of the Image of Law Public Person

Abstract

There is a conflictuous relation between the image rights, inserted as a fundamental warranty in the Federal Constitution, and the information conveyance eager for profits. Acting this way, media turns to be a handling and insanity tool, exchanging truth for fanciful, moulding the image of a public person according to their interests and conveniences, building and destroying it, caring less that this kind of attitude may defile the person's qualities for a determined period of time or even forever, for the advantage of a consumption society. We defend the true-information transmission with interests effectively public, repelling the media outrage. Aiming at giving effectivity to the image rights, it's essential the adoption of the preventive protection, which avoids the occurring or keeping of the illicit. The law procedure that's able to warrantee the inhibitory protection occurs through the "doing" or "not doing" obligations, mentioned on the paragraph 461 of the Procedural Civil Code.
