Resumo

Em busca da superação da análise compartimentalizada dos modelos processuais, notadamente do direito processual civil e do direito processual penal, o viés sistêmico que se permite inferir em decorrência da assimilação de ambos os ramos e as maneiras pelas quais mutuamente se afetam e se influenciam pode permitir a compreensão de certos fenômenos processuais que apontam exatamente para tal tendência de convergência, tal como a construção de uma teoria geral do processo, a expansão da jurisdição constitucional – e o próprio ativismo judicial. Sua eventual constatação deve decorrer de elementos objetivos e sua imbicação envolve a compreensão do conceito de acoplamento estrutural proposto por Luhman, no conjunto de sua autopoiese, a aceitar a oxigenação do modelo do fechamento operacional. A investigação proposta é de aferir se tal convergência pode mesmo ser identificada, e quais seus efeitos decorrentes para absorção de uma teoria unitária do processo, bem como se o sistema processual poderia obter vantagem operacional em sua aproximação.

A Unidade Processual e sua Compreensão Sistêmica

Abstract

Seeking to overcome the compartmentalized analysis of procedural models, notably the civil procedural law and criminal procedural law, the systemic bias that can be inferred due to the assimilation of both branches and the ways in which mutually affects and influences could allow understanding of certain procedural phenomena that points exactly for that trend of convergence, such as the construction of a general theory of the case, the expansion of constitutional jurisdiction - and the own judicial activism. Its eventual conclusion must due to objective elements and its association involves understanding the concept of structural coupling proposed by Luhman, in all of its autopoiesis, to accept the oxygenation of the operational closure model. The aim of this research is to assess if such convergence can really be identified, and what are its effects due to the absorption of a unitary theory of the case, as if the court system could obtain operational advantage in their approach.
