Abstract

The expansion of private procedural autonomy promoted by the Brazilian Code of Civil Procedure of 2015, particularly through the general clause governing procedural legal transactions set forth in Article 190, has opened new perspectives for the consensual structuring of procedural rules and for strengthening the cooperative model of civil procedure. Nevertheless, the application of these instruments to family law proceedings raises important concerns arising from the specific characteristics of family relationships, which are marked by the presence of fundamental rights, existential interests, situations of vulnerability, and limitations imposed by public policy. Against this background, this research aims to analyze the legal foundations of procedural negotiation in family matters and to investigate the possibility of systematizing a general theory of procedural legal transactions applicable to family law disputes. The study addresses the problem of identifying the legal foundations, requirements, limits, and standards of judicial review capable of reconciling private procedural autonomy with the constitutional protection afforded to family relationships. The research adopts the hypothetical-deductive method. Initially, it examines the historical development of private autonomy in civil procedure, the emergence of the theory of procedural legal transactions, and its constitutional and statutory foundations. It then investigates the specific features of Family Law and family proceedings, particularly their constitutionalization, the principles governing judicial protection in family disputes, and the compatibility between procedural autonomy and the nature of family requirements, substantive limitations, mechanisms of judicial review, and their potential to promote procedural adequacy. The research concludes that procedural negotiation is compatible with family disputes, provided that it is interpreted in light of the constitutional principles governing Family Law and remains subject to judicial review aimed at protecting non-disposable interests, vulnerable individuals, and the effectiveness of judicial protection. As its principal scientific contribution, the study proposes the construction of a general relationships. Finally, it analyzes the application of procedural legal transactions in family law proceedings, their validity theory of procedural legal transactions in family law proceedings, grounded on its own theoretical foundations and intended to guide their interpretation, application, and judicial control within family litigation.
